Check before you fall in love with a name

The most expensive branding mistake is not a bad name, it is a good name someone else already owns. By the time a conflict surfaces, you have a logo, a domain, printed packaging, and search rankings attached to it. A rebrand at that stage routinely costs 10 to 50 times what a five-minute check would have cost you on day one, and application fees are not refunded when a registration is opposed.

Trademark rights are territorial, which is the part most founders miss. A clear USPTO search says nothing about the UK register, and since Brexit an EUIPO mark no longer covers the United Kingdom at all. If you sell into the US, UK, and EU, that is three separate registers to clear, before you think about Canada, Australia, or a WIPO Madrid filing. That is why this tool searches 12 registers in one pass instead of making you run 12 separate searches on 12 government websites.

One honest caveat: no automated search replaces a clearance opinion from a trademark attorney. What it does is filter. If the exact name is already registered in your class in your market, you have your answer in seconds, for free, and you can move to the next candidate before the sunk costs start piling up.

Is this a full legal clearance search?
No. This is a knockout search: it catches exact, fuzzy, and phonetic matches against active registrations and pending applications. A full clearance search from a trademark attorney also covers common-law usage, design marks, and a goods-and-services overlap analysis, and you should get one before filing.
What do the clear, caution, and conflict verdicts mean?
Clear means no active exact or close matches were found in the registers you selected. Caution means similar active marks exist through fuzzy or phonetic matching, so review their Nice classes before filing. Conflict means an active trademark is registered for the exact name, which makes registration high risk.
Does a UK or EU trademark protect my brand in the US?
No. Trademark rights are territorial: a UKIPO registration protects you in the United Kingdom only, and an EUIPO mark covers EU member states but not the UK since Brexit. If you trade in the US, UK, and EU you need a filing, or a WIPO Madrid designation, for each one.
